Terms of Service

1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of VizaFlow, including our website, applications, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
If you do not agree, do not use the Service. If you are accepting these Terms for an organization, you represent that you have authority to bind that organization.
2. The Service
VizaFlow is a multi-tenant software platform designed for education consultancies and visa processing teams. Features may include lead and campaign management, admissions workflows, visa case tracking, multi-branch operations, roles and entitlements, and related operational tools. Features available to you depend on your subscription plan and organization configuration.
We may update, improve, or discontinue parts of the Service over time. Where a change materially reduces core paid functionality, we will provide reasonable notice when practicable.
3. Accounts and organizations
You must provide accurate account information and keep credentials secure. You are responsible for activity under your accounts and for ensuring that users in your organization use the Service in compliance with these Terms and applicable law.
Organization administrators control structure, branches, roles, and entitlements. You are responsible for configuring access appropriately and for the data your organization stores in the Service.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or misleading purposes
- Upload or process data you do not have the right to use
- Attempt to gain unauthorized access to other tenants, systems, or data
- Interfere with or disrupt the Service, including via abuse, scraping at scale, or reverse engineering beyond what the law permits
- Resell, sublicense, or provide the Service to third parties except as expressly allowed in your plan or a written agreement with us
- Use the Service to send spam or unlawful communications
5. Customer data
You retain ownership of the data you and your users submit to the Service (“Customer Data”). You grant us a limited license to host, process, transmit, and display Customer Data solely to provide, maintain, secure, and improve the Service, and as otherwise described in our Privacy Policy.
You are responsible for the accuracy and lawfulness of Customer Data, including personal data of students, applicants, staff, and other contacts. You must obtain any consents and provide any notices required under applicable privacy and education-related laws.
6. Subscriptions, fees, and trials
Paid plans, modules, and branch entitlements are billed according to the pricing, invoice, or order form presented to you. Fees are non-refundable except where required by law or expressly stated otherwise. We may change pricing for future billing periods with notice.
Trials or demo access, if offered, are provided “as is,” may be limited in features or duration, and may be withdrawn at any time.
7. Intellectual property
VizaFlow, including software, branding, documentation, and design, is owned by us or our licensors. These Terms do not transfer ownership of our intellectual property to you. You may not copy, modify, or create derivative works of the Service except as allowed by these Terms or written permission from us.
8. Third-party services
The Service may integrate with or link to third-party products (for example email, SMS, payment, or analytics providers). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services you choose to connect or use.
9. Confidentiality
Each party may receive confidential information from the other. The receiving party will use reasonable care to protect that information and use it only for purposes related to the Service, except where disclosure is required by law or the information is already public through no fault of the receiving party.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet every operational or regulatory requirement of your agency.
VizaFlow is an operational software tool. It does not provide legal, immigration, or educational counseling advice, and it does not guarantee visa outcomes.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from your use of the Service. Our aggregate liability arising out of these Terms or the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the claim.
12. Suspension and termination
We may suspend or terminate access if you breach these Terms, fail to pay fees when due, create security or legal risk, or if we discontinue the Service. You may stop using the Service at any time. Upon termination, your right to access the Service ends. We may delete Customer Data after a reasonable retention period, subject to our Privacy Policy and any written agreement with you.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.
14. Governing law
These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles, unless a different governing law is required by applicable mandatory rules or agreed in a separate written contract.
